These terms are an agreement between you and Jaden Joseph, operating as UPLFT, a sole proprietorship based in Victoria, British Columbia, Canada ("UPLFT", "we", "us"), of Victoria, British Columbia, Canada. By creating an account or using the app, you agree to them. If you do not agree, do not use UPLFT.
UPLFT is a fitness app, not a medical service. Nothing it shows you is medical advice, diagnosis, or treatment. It does not know your medical history. It cannot see you lift.
Consult a physician before starting UPLFT or any training programme, especially if you have a heart condition, high blood pressure, a chronic illness, an injury, are pregnant or postpartum, are recovering from surgery, or have been inactive for a long time. If a doctor has told you not to exercise, do not use this app.
UPLFT prescribes loaded resistance training performed without supervision. That carries a genuine risk of injury, including muscle strains, joint and tendon injuries, back injury, fainting, cardiac events, and in rare cases serious or permanent harm or death. You accept that risk voluntarily.
The app suggests a movement and a weight. You decide whether to do it. You are responsible for:
Stop immediately and seek medical attention if you feel chest pain, dizziness, faintness, shortness of breath, or sharp or unusual pain. The app cannot detect any of these.
Estimated maxes, calorie targets, macro targets and recommended loads are estimates produced by formulas, not measurements and not prescriptions. They are starting points to adjust from. Nutrition figures come partly from public databases and partly from automated estimates of photos and descriptions, and they can be wrong. Do not rely on them for any medical or clinical purpose.
By using UPLFT you confirm that you are in good enough health to exercise without supervision, and that you will stop if that stops being true.
You must be at least 18 years old. The app is designed and tested for ages 18 to 80. You must be able to form a binding contract, and you must not be barred from using the service under the laws that apply to you.
You are responsible for everything done through your account.
Sign-in uses a one-time code sent to your email; there is no password. Keep access to that email address secure. Anyone who can read your email can sign in as you. Tell us at hello@uplftapp.com if you think someone else has access.
One account per person. Do not share it.
UPLFT offers auto-renewing subscriptions purchased through Apple. Payment is charged to your Apple Account at confirmation.
Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends, at the price then in effect for your plan.
Manage or cancel in Settings → Apple Account → Subscriptions on your device. We cannot cancel or refund an Apple subscription for you. Apple owns that relationship. Deleting your UPLFT account does not cancel your subscription; you must cancel it separately.
If a free trial is offered, any unused portion is forfeited when you buy a subscription.
Refunds are handled by Apple under the App Store terms, not by us.
We may change prices. A change takes effect at your next renewal and you will be told in advance, with a chance to cancel first.
You may use UPLFT for your own personal training.
You may not:
The app, the training engine, the exercise library, the video demonstrations, the programming logic, the text, the designs and the UPLFT name and marks are ours or our licensors', and are protected by copyright and other laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app for your own training. Nothing else is granted.
Your data is yours. Your training history, photos, weigh-ins and food logs belong to you.
You grant us a licence to host, store, process and display that content solely to operate the service for you, for example to store your progress photo and show it back to you, or to read your training history to build your next session. This licence exists only so the app can function. It ends when you delete the content or your account, except for the anonymised and legally-required records named in the Privacy Policy.
We do not claim ownership of your content, and we will not publish it, sell it, or use it to promote UPLFT without asking you first.
If you send us feedback or a suggestion, we may use it to improve UPLFT without owing you anything for it.
We may change, suspend or discontinue features. We will not intentionally delete your training data without notice, and the deletion control described in the Privacy Policy remains available to you in the app while your account is open.
There is no export button in the app. You can ask us for a copy of everything we hold about you by emailing hello@uplftapp.com, and we will send it to you within 30 days.
We do not promise the service will be uninterrupted or error-free.
We may suspend or terminate your account if you breach these terms, if we are legally required to, or if your use risks harm to other users or to the service. Where it is reasonable to do so, we will tell you why and give you a chance to respond.
You may stop at any time by deleting your account in the app. Remember to cancel your subscription separately with Apple.
To the fullest extent permitted by law, UPLFT is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app's recommendations are appropriate for you, that its estimates are accurate, or that using it will produce any particular result.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Nothing in these terms limits liability that cannot be limited by law, including under British Columbia consumer protection legislation.
You agree to indemnify and hold harmless Jaden Joseph, operating as UPLFT and its officers and contractors from claims arising out of your use of UPLFT, your breach of these terms, or your violation of anyone else's rights, except to the extent the claim arises from our own wrongdoing.
These terms are between you and us, not you and Apple. Apple is not responsible for UPLFT or its content and has no obligation to support or maintain it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory non-compliance, or consumer protection claims.
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules.
Before filing anything, please email hello@uplftapp.com so we can try to resolve it directly.
If that does not resolve it, the courts of British Columbia have exclusive jurisdiction.
Nothing here prevents you from bringing a matter to a small claims court or a consumer protection regulator where the law gives you that right.
